This privacy notice explains what information the Financial Intelligence Unit (FIU) collects and what that information is used for.
Who we are
The FIU is the controller for all personal data processed by the FIU, staff or other appointed officers.
The FIU is a body corporate established by the Financial Intelligence Unit Act 2016 (FIU Act).

Our approach to personal data
We respect an individual’s fundamental right to privacy. In general, the FIU endeavours to be open and transparent with individuals when processing their personal data. However, in some limited exceptions, for example when investigating an allegation or undertaking a law enforcement function, it is not possible to do so.
Collection and use of personal data
The FIU is a competent authority under Schedule 1 of the GDPR and LED Implementing Regulations 2018 'The Regulations'.
Under Section 5 of the FIU Act, the FIU has the functions of —
(a) receiving, gathering, analysing, storing and sharing information about financial crime (whether in the Island or elsewhere);
(b) assisting with the prevention and detection of crime, and in particular, financial crime (whether in the Island or elsewhere);
(c) cooperating with law enforcement agencies (see section 10); and
(d) contributing to the reduction of crime, and in particular, financial crime and to the mitigation of its consequences.
Depending on the function, and the powers used in each function, depends on whether personal data is processed is processed under General Data Protection Regulations (GDPR), or the Law Enforcement Directive (LED).
To make a complaint
If you are unhappy with the way we deal with your personal information you can submit a complaint to the FIU Data Protection Officer who will work with you to resolve any issues.

The Isle of Man’s Information Commissioner is the independent supervisory body responsible for upholding the public's information rights and promoting and enforcing compliance with the Island's information rights legislation.
You have the right to make a complaint to the Information Commissioner under Article 77 Applied GDPR, Article 52 Applied LED and Regulation 122 of the GDPR and LED Implementing Regulations. Further information can be found on the Information Commissioner's website.
How to request your personal information
Under the Data Protection Act 2018 you have a right of access to your personal data and to check the accuracy of that data by making a Data Subject Access Request.
A subject access request is made by filling in our Subject Access Request Form or contacting the Data Protection Officer (DPO).

Subject access requests must be responded to promptly and in any event within a maximum of 1 month.
